Reproduction of images owned by the Museum Kurhaus Kleve

For the use of images of the Museum Kurhaus Kleve are costs that benefit the museum in full. A fee of 130,- € (excl VAT, postage and packing) have to be paid, which is composed of image and copyright fees of the Museum.

The use of images under the ownership of the Museum Kurhaus Kleve is permitted only with prior written consent.

Terms and Conditions set out by the Museum Kurhaus Kleve for the use of images


Preface
The use of images belonging to the Museum Kurhaus Kleve is permitted under the following terms and conditions. Deviating arrangements require prior written consent. Arrangements deviating from the stated terms and conditions require prior written consent.

Reproduction of Images
For the purpose of reproduction the user will be provided with images in the form of digital documents (on CD-Rom or DVD) or transparencies. Transparencies remain property of the Museum Kurhaus Kleve and are to be returned within three months without prior notification. This deadline can be extended upon prior request. Digital files are to be deleted or destroyed after their use for the authorised purpose.
Unless the Museum Kurhaus Kleve has a reproducible template for the image at its disposal (digital image or transparency), an image will be produced at the expenses of the user. The image remains property of the Museum Kurhaus Kleve.
The image is given to the user exclusively for the agreed purpose. Any additional usage requires the Museum Kurhaus Kleve’s prior written consent. The user is obligated to give exact details as to the purpose of the loan.
The image may not be saved, reproduced, archived, duplicated, copied, changed or used in any other way without prior written consent by the Museum Kurhaus Kleve. Distribution to a third party is only permitted with prior written consent by the Museum Kurhaus Kleve.

Publication on electronic media
If publishing the image on data carriers (CD-ROMs, DVDs), networks and the internet, the user is required to adhere to the following terms and conditions in addition to those stated above:

- the resolution may not exceed 72 dpi
- the photographs must be adequately labelled, including the author. If possible, the label should also include a link to the Museum’s website (www.museumkurhaus.de)
- as a rule, internet usage is restricted to a period of six months, unless a different agreement was made

Liability
The user is liable for the use of the images in accordance with the terms and conditions cited, as well as all other demands arising from its usage.

It is the user’s responsibility to return all transparencies given out on loan in sound condition.
Compensation will be claimed for all lost or damaged images. All risks of damage or loss (including shipping) have to be born by the user.

Warranty
Claims as to the content and volume of a delivery or the technical quality of the images need to be made within four weeks.

Complimentary copy
The user is obligated to send the stated number of complimentary copies, without delay and free of charge, for each publication, in print or electronic media, which has been produced using images belonging to the Museum Kurhaus Kleve. This should also include a note on the quantity of distribution and the number of images used.

Payment
The invoice is sent separately by the Freundeskreis Museum Kurhaus und Koekkoek-Haus e.V.

Breach of contract – Penalties
Disregard of the terms and conditions will lead to the revocation of usage rights (of the images). In case of illegal usage or unauthorised circulation of materials, the Museum Kurhaus Kleve reserves itself the right to take legal action.

Applicable Law, Place of fulfilment and Place of jurisdiction
For all uses the applicable law is that of the Federal Republic of Germany. Place of fulfilment and jurisdiction is Kleve.
